June 7, 2018: Twenty-five Rotarians and a guest (John Reed’s stepson, Jim Best) were present as Attorney Michael O’Donnell spoke about the issues related to the regulation and licensing of medical marijuana operations in Pennsylvania. John Reed was the host. A board meeting preceded. Attorney O’Donnell is a member of the PA Medical Cannabis Society and responsible for legal education programs for the society. Act 16 was passed by the PA Legislature in 2016 with a two year window before taking effect, and implementation is being run by the Department of Health. Medical conditions for which marijuana can be prescribed are stipulated in the law.  The Dept. of Health has responsibility for certifying physicians (to be certified a physician must attend a 4 hour course and be registered with the DoH, and they are required to update the DoH on the patient’s condition); and licensing the distribution pharmacies and the growing facilities. The applications require a $5000 non-refundable  fee, and, if granted, an up front payment to the state of $200,000.  It is clear that this is a major funding source for the state.  Because marijuana is still an illegal substance by federal definition, many complications issue, including banks not being able to accept funds from such operations because of federal law.  It is expected that in the long run this will lead to the legalization of recreational use as well as medical use.  An interesting and complicated subject for sure.
